Terms & Conditions

These general terms and conditions apply to the services provided by Auntie Abroad. By visiting the website, reading the pages, booking a free video call and purchasing a package, the Client agrees to have read, understood and agreed with these Terms & Conditions.

Definitions

Client: Person who hires services from Auntie Abroad Agency by purchasing a package via its website and anyone who the services are hired for if this is done by a representative, such as a parent or company

Company: Auntie Abroad Agency, also operating as Aunty Abroad Agency, or any of its staff, hereafter also referred to as “Auntie Abroad”

Day of Arrival: The day on which the person or persons arrive at the airport, port, train station or, if arriving by road, the new home or other destination in the Netherlands

Relocation: The legal immigration and/or move of a person or persons from another country to the Netherlands

Agreement: Purchasing and completing payment for a package from Auntie Abroad constitutes an Agreement between the Client and Auntie Abroad.

General

  1. A prospective Client cannot hire Auntie Abroad if the prospective Client is under the age of 18.
  2. The Client is obliged to give complete and accurrate contact details, such as a postal addresses in both countries, if already available and always a phone number, a working email address and video call contact details.
  3. Auntie Abroad reserves the right to refuse a Client without giving a reason; 
  4. If the Client is a legal entity and/or company, the person hiring the services herewith confirms that he or she is authorized to act on behalf of the legal entity and/or company.

Cancellation

Cancellation is possible within seven (7) days after having paid for a service package by Auntie Abroad unless the Day of Arrival falls within those 7 days. Cancellation must be done via email and be confirmed in a subsequent video call.

As the Client has the option of booking and having a free video call before purchasing a package, purchasing a package from Auntie Abroad strictly speaking does not constitute a distance sale.

Both the Client and Auntie Abroad have the right to terminate the agreement without any compensation being required from either side in the event of force majeure such as a strike, fire, war, mobilisation, lock-down, flood, any type of other (natural) disaster and any other external factors that make the execution of the relocation or the provision of the services impossible, including death or severe illness.

Confidentiality

The Client and Auntie Abroad are obliged to keep confidential all confidential information that they share with each other in the context of the services provided by Auntie Abroad. Information is considered confidential if it is indicated as such or if this results from the nature of the information in question. The confidential information will only be used for the purpose for which it was provided.

If the Contractor is obliged to disclose confidential information on the grounds of a statutory provision or court order, Auntie Abroad is not liable for any possibly resulting damages and the Client is not entitled to cancel the services hired through the purchase of a package from Auntie Abroad unless within 7 days after the purchase date.

Reviews

The Client can post a review of his, her or their experiences with Auntie Abroad after first having contacted Auntie Abroad. Such a review can be positive, neutral or negative and may contain an explanation. The language must always be civilized and Auntie Abroad reserves the take some action if a review is deemed inappropriate by Auntie Abroad.

Specifications

For the client, it is of great importance to be complete and diligent when providing details on what the Client needs when asking Auntie Abroad to track down information for the Client or carry out any other services such as receiving a key or paperwork on behalf of the Client. The Client must provide as much detail as possible. The Client acknowledges that if the Client gives inaccurate, incomplete or wrong details, this can cause complications or result in receiving the wrong information from Auntie Abroad. 

Validity

If one or more provisions from these general Terms & Conditions are void or voidable, the remaining provisions will remain fully applicable. In that case, the parties will agree on new provisions to replace the void or nullified provisions, taking into account as much as possible the purpose and intended meaning of the original provision.

Liability

Auntie Abroad accepts no liability for any damages that the Client may incur in relation to any of the services provided by Auntie Abroad, such as but not limited to an allergic reaction to a food ingredient consumed during a meal or a slip and fall. Auntie Abroad cannot be held liable for any consequential damages, loss of profit, income losses, missed savings and any other damages due to any stagnation or cancellation of any agreement or understanding between the Client and a third party such as an employer or prospective employer or, as the case may be, a customer or potentional customer, in relation to the Client’s relocation. Auntie Abroad is not liable for damages related to mishaps of any nature that may occur during the relocation of household pets.

Applicable law and disputes

The relationship between the Client and Auntie Abroad is governed by Dutch law and any disputes that cannot be settled amicably will be submitted to the District Court in Amsterdam, the Netherlands or, as the case may be, a different district court in the Netherlands.
